Welcome to Boalivin. These Terms and Conditions apply to the use of our website, services, and the platform made available through [www.boalivin.com] (the “Website”). By accessing or using our Website and/or services, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions:

  • Boalivin: the company operating the platform with offices in the Netherlands, Spain, Colombia, and Miami.
  • Visitor: any natural or legal person visiting the Website and/or using Boalivin’s services.
  • Provider: a business, service provider, or organization offering services or products through Boalivin in the categories Experiences, VIP Transport, Professional Services, Health & Wellness, Real Estate, Hospitality & Entertainment, Living & Lifestyle.
  • Platform: the online environment operated by Boalivin where Visitors and Providers can connect.
  • Services: all activities offered by Boalivin, including (but not limited to) organizing package trips, arranging VIP transport, and managing the business directory.
2. Scope of Application
  • 2.1 These Terms and Conditions apply to any use of the Website, the Platform, and the Services of Boalivin.
  • 2.2 Deviations from these Terms and Conditions are only valid if confirmed in writing by Boalivin.
3. Role of Boalivin
  • 3.1 Boalivin acts as an intermediary and information platform. We connect Visitors and Providers but are generally not a contracting party to any agreement concluded between a Visitor and a Provider
  • 3.2 Where applicable, Boalivin may itself organize services (such as package trips or VIP transport). In such cases, Boalivin acts as the contracting party, which will be clearly indicated.
  • 3.3 Boalivin does not guarantee that the information provided by Providers is complete, accurate, or up to date.
4. Use of the Platform
  • 4.1 Visitors may only use the Platform for personal and legitimate purposes.
  • 4.2 It is not permitted to use the Platform for fraudulent or misleading activities, to distribute unauthorized content, or to disrupt the functionality of the Website.
  • 4.3 Providers are responsible for the accuracy and completeness of the information they provide.
5. Liability
  • 5.1 Boalivin shall not be liable for any damages arising from an agreement between a Visitor and a Provider
  • 5.2 Boalivin shall not be liable for delays, cancellations, damages, losses, or costs arising from the use of a Provider’s services.
  • 5.3 Boalivin shall only be liable for direct damages that are the result of willful misconduct or gross negligence on the part of Boalivin. Any liability shall be limited to the amount covered by our liability insurance.
6. Bookings and Payments
  • 6.1 When a Visitor makes a booking with a Provider via Boalivin, the agreement is concluded between the Visitor and the respective Provider.
  • 6.2 Payments are made directly to the Provider, unless otherwise expressly agreed and indicated by Boalivin.
  • 6.3 Cancellation and refund policies are those of the respective Provider, unless stated otherwise.
7. Intellectual Property Rights
  • 7.1 All intellectual property rights relating to the Website and the Platform are owned by Boalivin or its licensors.
  • 7.2 It is not permitted to copy, distribute, or reuse any part of the Website without prior written permission from Boalivin
8. Data Protection
  • 8.1 Boalivin processes personal data in accordance with applicable data protection laws.
  • 8.2 Please refer to our Privacy Policy, available on the Website.
9. Admission of Providers
  • 9.1 Providers can register through the contact form available on the Providers page.
  • 9.2 Boalivin reserves the right to refuse applications or remove accounts at its sole discretion and without justification.
  • 9.3 Providers grant Boalivin the right to publish and use their submitted information (including logos, photos, and descriptions) for promotional purposes.
10. Force Majeure

Boalivin shall not be held liable for any failure to perform obligations if such failure results from circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, wars, pandemics, or government measures.

11. Amendments

Boalivin may amend these Terms and Conditions from time to time. The most current version will always be published on the Website.

12. Governing Law and Jurisdiction
  • 12.1 These Terms and Conditions shall be governed exclusively by Dutch law, unless mandatory law provides otherwise.
  • 12.2 Any disputes shall be submitted to the competent court in the Netherlands
